As a contractor or supplier, you compete in a tender for an attractive contract. You still have a lot of questions about the tender, but there is little time and the documents need to be submitted within a short period of time. Neither trouble nor expense will be spared in your attempt to satisfy the principal requirements and criteria. You make a low offer, but still receive a letter of refusal, and the contract is awarded to your rival! You are left wondering whether you’ve been treated unfairly and whether there’s anything you can do about it.
That’s when procurement law comes in.
What is meant by procurement law?
When governmental institutions such as local councils, the Tax and Customs Administration, housing corporations and agencies responsible for healthcare and education, purchase goods or services from private companies, procedures known as procurement procedures apply when choosing the company. Above a certain threshold amount, the Dutch government is obliged to put a commission out to tender on a European level. They should perform this with the utmost care.
Commercial institutions are also increasingly often making use of tenders when awarding contracts.
For you, as a supplier, tendering means putting a lot at stake, especially when there the tender involves potentially extending an agreement or in the case of outline agreements. Dealing with procurement procedures in the correct way is thus of great importance.
